AISV Compliance Framework Pay slips Please scroll to the bottom of the page for contacts and links Do you need to comply? Yes, compliance is required for all employers under the Fair Work Regulations 2009 (Cth.). Conditions of compliance An employer must issue to the employee a written pay slip relating to each payment by the employer of an amount to the employee as remuneration. If you have to comply, what do you have to do? The pay slip must be issued within one day of the payment to which the pay slip relates being made to the employee. The contents of pay slips are mandated. A detailed explanation of these requirements is available from the Fair Work Australia website. What are the consequences if you don't comply? Fair Work Australia Inspectors can issue employers with an infringement notice for failing to meet pay slip requirements. An infringement notice is similar to an on-the-spot fine and is an alternative to taking matters to court. Generally an employer will have 28 days to pay the penalty imposed by the infringement notice. Maximum infringement notice fines: • $330 per contravention - for an individual • $1650 per contravention - for a corporation. If an employer’s failure to meet the requirements is serious, wilful or repetitive, Fair Work Inspectors may recommend the matter be taken to court. The penalties listed above apply from 1 July 2009. Who will help you? AISV contacts: Kerri Knopp Sandro Mazzotta Sarah Matar
