Do you need to comply?

Yes - if you intend starting an Outside School Hours Care (OSHC) program that will qualify for the Australian Government Child Care Benefit.

Conditions of compliance

To become an approved OSHC operator:

  • a person/s or organisation must apply to the Department of Families, Community Services and Indigenous Affairs
  • be assessed as suitable to become an approved child care operator
  • be allocated a number of outside school hours care places.

To enable the Department to assess an applicant's eligibility to become an operator, you must complete an application form and submit relevant documentation for approval as a Child Care Benefit service.

If you have to comply, what do you have to do?

As an operator of an OSHC service you accept the legal responsibilities associated with setting up and administering the service. These include:

  • meeting Commonwealth accountability requirements
  • repayment of Commonwealth funds which cannot be acquitted
  • ensuring the operator and key personnel are suitable persons to operate a child care service
  • compliance with Commonwealth, State/Territory and local government laws and regulations
  • claiming Child Care Benefit and other entitlements on behalf of eligible families.

Outside school hours care services will be required to participate in a quality assurance system to continue to be an approved service for Child Care Benefit purposes.

What are the consequences if you don't comply?

You may be in breach of the family assistance legislation. Australian Government funding may be terminated and sanctions could be imposed.
