Do you need to comply?

Yes, if your school owns and operates a private bus.

Conditions of compliance

Under the Public Transport Competition Regulations 1999 (VIC), schools that operate private buses must have certain policies and procedures in place for the protection of students, school staff and the general public when transporting students to and from school activities.

If you have to comply, what do you have to do?

The accredited or principal bus driver is responsible for implementing and maintaining written procedures. At a minimum, your school’s private bus policies should include a maintenance management system and an emergency management plan. The policies should include the person responsible to carry out the procedures, as well as where, when and how bus safety inspections should take place.

The maintenance management system guidelines should include daily operation inspections, defect reporting, safety inspections and independent bus inspections. For a list of suggested bus inspections, click here.

A private bus service operated by a school is used to exclusively transport students and teachers to and from school activities. Private buses are not to be used to transport the general public, nor can they be hired by others, used for commercial use or lent out for a fee. It is important to note that a private bus can not be used to convey students to and from their home and school on a regular basis.
