Do you need to comply?

Yes, if your school receives funding from the Australian Government under the Schools Assistance (Learning Together - Achievement through Choice and Opportunity) Act 2004 (Cth.).

Conditions of compliance

To receive funding, your school must sign a funding agreement with the Department of Education, Employment and Workplace Relations (DEEWR) covering the 2005-2008 quadrennium. In some cases, the Funding Agreement is between DEEWR and the school system authority.

The Funding Agreement encompasses both financial and educational accountability

If you have to comply, what do you have to do?

Provide to DEEWR two Compliance Certificates covering:

  • Participation in literacy and numeracy testing
  • Reporting to parents on literacy and numeracy achievement against national benchmarks
  • Physical activity in the curriculum
  • Functioning flagpole and flying the Australian flag
  • Display of National Safe Schools Framework poster
  • Display of the Values Education poster
  • Provision to parents of plain English student reports
  • Provision of specified school performance information
  • Implementation of the Interstate Student Data Transfer Note (ISDTN)

Two Compliance Certificates need to be completed for each program year. All items (except school performance information) are to be certified by the end of March of the following year. School performance information is to be published by 30 June of the following year and certified by 31 October of that following year.

Independent schools are also required to provide, electronically to DEEWR, the Financial Questionnaire for Non-Government Schools (FQ) and the Census of Non-Government Schools.

What are the consequences if you don't comply?

Where a school has not complied it will be asked by DEEWR to provide reasons for the failure to comply and outline steps being taken to meet the requirements in the following year. DEEWR reserves the right to undertake an audit of the compliance information supplied to schools.
